Terms and Conditions

As used in this Agreement, "we," "us," "Ticketmosh," www.ticketmosh.com "company," "website," means the Ticketmosh Co., Ltd or any of its affiliates, and "service user," "you," "online members," "registered members," “Buyer,” “Buyer(s)” "himself/herself," "he/she," "user," means the applicant.

General Terms and Conditions

1. Terms and Conditions and General Agreements

Ticketmosh has launched the website www.ticketmosh.com (hereinafter called “website”) to provide digital ticketing solutions. The use of this website by the service user shall be used under the terms and conditions of this agreement. The service user should, therefore, thoroughly study the terms and conditions of this agreement and/or the terms and conditions of any other agreement, on the website by the company before using the website. By entering this website, the service user hereby accepts and agrees to comply with all of the terms and conditions. If the service user does not want to be bound by the terms and conditions, the service user must refrain from entering and using the services of this website.

2. Rights, duties and responsibilities of the Service User

2.1 The company reserves the right to allow only service users who are registered members to order merchandise and/or services and/or to participate in promotional activities, organized through the website such as the purchase of goods.

2.2 In registering as an online member, the service user must provide the most current, correct, and complete personal information.

2.3 The service user agrees to change and/or to update personal information, specified in 2.2 to ensure that they are correct and up to date.

2.4 The service user agrees to take full responsibility for, but not limited to, the protection and quality of the ticket from theft, losses and any damages to the ticket itself.

2.5 The service user agrees to keep the username and password confidential. If the service user gives or allows any other party to use the personal information and/or username and password for any purpose, it shall be deemed that such use was made by the service user himself/herself and may be legally binding for the service user under the Thai law.

2.6 In the case that the service user exercises the rights in such a way that causes damage to other users, the service user agrees to be liable for such damage in full amount.

2.7 Online users who are younger than 18 must have parental approval before completing any financial transactions such as making an online order to buy merchandise and/or to participate in buying goods with other users.

2.8 The service user agrees that all tickets are not allowed to be resold, exchanged, offered for sale for profit, or used for any form of commercial trade purposes without the written consent of the company or event organiser.

2.9 The service user agrees that the ticket cannot be exchanged for gifts or any form of monetary compensation including promotional credits.

2.10 The service user agrees that the ticket can only be used for entry, and does not include, without limitations, food & beverage, logistics, gifts, and accommodation unless stipulated in writing by the event organiser.

2.11 The service user agrees that late arrivals after the written time on the ticket may be denied entry by the event organiser. Under such cases, if the event includes an intermission or break time, the service user may be granted entry upon the approval of the event organiser. No refunds will be given in any form should such an incident occur.

2.12 The company reserves the right to revoke online membership of any service user immediately without prior notice if the company finds that the following actions have been committed by the service user:

2.12.1 The service user provided false information, specified in 2.2, and/or fails to update the latest personal information.

2.12.2 The service user fails to keep his/her username and password confidential.

2.12.3 The service user committed improper, illegal or immoral action(s) and/or when there is a cause to believe that the service user has intentions to make fraudulent, improper, illegal and/or immoral action(s)

3. Limitation of Liability

3.1 Content Although the company regularly conducts review(s) on the contents and consistency of the content on the website, the company cannot provide assurance that those contents shall always be correct, complete or up to date. The company, therefore, will not take any responsibility, directly or indirectly, for any mistake(s), delay of information availability and/or interruption of any equipment connection(s), whether or not someone has already notified and/or made a recommendation to the company that there was a chance for such a problem to occur.

3.2 Responsibility Over the Events and Services The service user acknowledges that the company is only a digital ticket distributor for 3rd party event organisers and service user(s). The company is not involved in any way with the arrangement, activities, and/or organization of the event organized by the event organiser sold on www.ticketmosh.com. The company, therefore, is not responsible for any damage, directly or indirectly, caused to any service user.

3.3 Service System The service user acknowledges and agrees that the company cannot make an assurance that the access or the use of website, in whole or in part, cannot be made successfully, quickly, free of interference or mistakes all the time. The service user agrees that the company cannot assure that personal information provided by the service user, content, materials, products (including software) or services included on or otherwise made available to you through this site; their servers; or electronic communications sent from Ticketmosh are free of viruses and/or other harmful components. Ticketmosh will not be liable for any damages of any kind arising from the use of this site or from any information, content, materials, products (including software) or services included on or otherwise made available to you through this site and/or provided by the service user, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing. If such damages occur, the service user acknowledges and agrees that the company is not responsible for any damages caused to any electronic devices and/or the service user.

3.4 Refunds It is the responsibility of the event organiser (hereinafter called “Organiser”) to communicate its refund policy to Buyers and to issue refunds to Buyers via the Site or otherwise. If a Buyer desires to request a refund, Buyer must request the refund from the Organiser. All communications or disputes regarding refunds are between the Organiser and Buyer and Ticketmosh will not be responsible or liable in any way for refunds, errors in issuing refunds, or lack of refunds in connection with the Services. All communications and disputes regarding chargebacks and refunds are between the Organiser and Buyer and Ticketmosh will not be responsible or liable in any way for chargebacks in connection with a Buyer's use of the Services. If you are a Buyer and you wish to request a refund in connection with an event listed on the Services, you should contact the applicable Organiser directly.

3.5 Damaged tickets, ticket theft and/or losses The service user hereby agrees and acknowledges that Ticketmosh will not be responsible and/or liable in any way for damages of any kind arising from damaged tickets, ticket theft and/or losses.

4. Links To Other Websites

The website contains links to other websites which are not under the care of the company. Therefore, the service user acknowledges and agrees that the company is not responsible for any of the contents shown in those websites and/or for any damage that may occur from visiting those websites.

5. Personal Information

Personal information of the service user, mentioned in 2.2 and 2.3 will be maintained according to the policies of the company.

6. Rights of the Company

6.1 The company is entitled to correct, change or cancel any Terms and Conditions and/or Agreements without having to inform the service user in advance and/or compensate the service user for any damages should it arise as a result of such change.

6.2 The service user agrees and accepts that the trade mark, content, idea, presentation style, and software, developed and used to provide the service in this website, is protected by intellectual properties law. No one, including the service user, is allowed to copy them, either in part or in whole.

6.3 All contents shown in the website are under the copy right law. The service user can make use of the contents to support the use of the website services only. No one, including the service user, is allowed to use or copy those contents for any other purposes.

7. Safety

7.1 For your safety, the service user agrees to fully cooperate and follow instructions and/or policies as announced by the company and/or Organiser in order to enter and remain in the event. Failure to do so will result in your denial of entry or removal from the event. The service user agrees that there will be no compensation from the company and/or Organiser in any way or form should such an incident happen. The service user also agrees to not demand compensation from the company and/or Organiser in any way or form under such scenario.

7.2 For your safety, the service user agrees to allow the company and/or Organiser to conduct any safety and security checks with your full cooperation at the event. In addition, the company and/or Organiser reserves the right, at all times and at its sole discretion, to deny entry or remove any service user without any form of compensation and/or notice, if it has been found that:

7.2.1 The service user has purchased tickets from unofficial ticket distributors. The service user agrees that the Organiser has the sole right in determining the official ticket distributor(s). It is the service user’s responsibility to check with the Organiser to confirm if a distributor is official or not.

7.2.2 The service user is found to be in possession of a threatening and/or illegal item, and/or is deemed to be a threat to the safety of others.

7.3 The service user agrees that the company is not held liable and/or responsible for any valuables or belongings that are lost, damaged, or stolen at the event. The service user agrees to not demand compensation from the company in any way or form should such an incident happen.

7.4 The service user agrees that the company is not held liable and/or responsible in any way or form, for any form of damages to the service user that arises from, but not limited, terrorism, fights, protests, riots, and force majeure.

8. Miscellaneous

8.1 The service user agrees to not resell, exchange, duplicate, or conduct any form of commercial trade on the wristbands, tickets, sticker stamps, or any other form of event entry item for admittance as provided by the event organiser, without the event organiser’s approval. Any violation or attempt to violate will result in an investigation and may result in the service user’s immediate removal from the event and/or entry denial.

8.2 The event organiser and company has the right to deny the service user entry into the event should any prohibited items are found to be brought by the service user into the event. This includes, but not limited to, weapons of any kind, audio and/or video recording devices, illegal substances or drugs and fireworks.

9. Governing Law

The terms and conditions under this agreement and/or any other terms and conditions and agreements created by the company that appear on this website are governed by Thai law and do not conflict with the law.
